1. Agreement to Terms

By downloading, installing, or using Moviq (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from using the App and must delete it from your device immediately.

2. Description of Service

Moviq is an offline-first movie discovery, cataloging, and personal tracking application. Key functionalities include browsing metadata, managing custom collections, following actors, taking private notes, and analyzing movie ratings. Moviq does not stream, host, download, or distribute copyrighted video files or movies.

3. Local Storage & User Backup Obligations

All watchlists, notes, ratings, and customization choices are saved solely in local iOS storage interfaces. Because we do not run account databases or sync servers:

• You are solely responsible for protecting your device and local data.
• Uninstalling the App will result in the permanent deletion of all local library files, notes, and records.
• We cannot recover deleted data on your behalf. We recommend using standard iOS iCloud/iTunes backups to secure your data.

4. User Responsibilities

You agree to use the App only for lawful, personal, non-commercial purposes. You are responsible for ensuring that your usage complies with local laws and App Store regulations. You may not copy, reverse-engineer, modify, or distribute the App's binary, asset structure, or source code without explicit written consent.

5. Age Restrictions & Age Gate

Moviq is intended for users of all ages, but complies strictly with child safety regulations (such as COPPA). If you are under 13 years of age, you must toggle the "Under 13" setting in the app. For designated under-13 users, all ad-targeting and ad serving functions (Google AdMob) are fully suppressed and deactivated, and no advertisements will be rendered.

6. Third-Party Content & Partners

The App integrates external services to enrich your user experience:

• TMDB API: Movie information, posters, ratings, and cast descriptions are fetched from The Movie Database (TMDB). This app uses the TMDB API but is not certified, licensed, or endorsed by TMDB. You must respect TMDB's Terms of Use.
• Google AdMob: Full-screen advertisements are served through the Google Mobile Ads SDK for monetization. By using the ad-supported features, you acknowledge that AdMob may process general location data and device IDs.
• YouTube: Video trailers are played via public embeds or opened in your default web browser. Movie trailers are subject to YouTube's Terms of Service.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DATA DYNAMICALLY RETRIEVED FROM THIRD-PARTY SERVICES (TMDB) WILL ALWAYS BE ACCURATE, COMPLETE, OR UP-TO-DATE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law provisions.
